    When xyz had his Eb-3 140 approved, by definition he was OK'd to be immigrant in that category with THAT date. When he files for an EB2 he is "OK'd" to be an immigrant in that category at THAT date.

    Based on the same language English that you have studied, and I have studied, the term 'That' refers to Eb-3's PD. One cannot just throwaway all the merit earned on Eb-3. Which precisely what you are asking one to do.

    Porting is a right justice served. Of course, not everybody are eligible for that.

    "EB-2 India. This category is expected to remain unchanged or to move very slowly forward (by a week or so) in the short-term. This is mainly caused by the fact that many EB-3 India applicants (there are approximately 60,000 EB-3 India pending cases) are �porting� their priority dates into the EB-2 India category and are thus taking visa numbers.


    EB2 India is slowwly becoming EB3 as thousands are porting from EB3 to EB2. Some of them are really worthy of EB2 and some of them are fradulent.

    EB2 India applicants should wake up from their celebratio of a few months leap and get ready for slow movement or retro.

    Guys wake up and fight to make the porting rules veryu strong if not stop porting. The rule should be if I140 for porting is denied then the applicatnt should loose his/her initial EB3 priority date also as he /she has indicated that he/she is no longer working in the position as described in EB3 labor. This will make sure that fradulent applicants cannot port from EB3 to EB2.

    P.S: I know I will get thousands of REDs. I do not care... EB2 I guys wake up.. Time is running out.. EB2 I will very quickly become same as EB3I.

    If portings from Eb3 to Eb2 are legit, and you still consider that to be fraud, then everybody's Eb-2 applications (resulting from with or without porting) are potential frauds.

    Thats a ridiculous assumption!

    Got the CPO email at 11 PST today (8/24) !!!

    Priority Date: Feb 12, 2006
    EB2 India, NSC

    I opened an SR on 8/9 but I haven't received any response to it. I didn't do anything else.

    A huge Thanks to IV and everyone here - you kept the hopes up.

    You are very practical and have excellent points.
    Sometimes, ppl do get carried away by their passion (height of desperation if one looks at it another angle). We have to accommodate folks that cannot have a nonchalant attitude towards Immigration. Just like health care, GC stirs up our deepest and strongest emotions. For many, GC is an all-or-nothing proposition (again let's not fret about why it might be so, because they might have their own good reasons). Regardless, i agree with you completely, civility should not be lost. We have a broken Immigration system - all i care is how to fix it.

    I am becoming a donor for the following reasons -
    1. It is better to be informed and be involved rather than be "out of the loop" or in the dark
    2. It is not free to get anything done in the commercial capital of the planet
    3. Selfish motivation - life is short. i would like to see the end of this struggle as soon as i can. personally, cannot be a mute spectator esp. when i see someone else fighting for MY cause and I being fortunate to lend a helping hand
    4. Altruistic motivation - gives some meaning to life whether we get anything done or not at the end of the day. if successful, would have the satisfaction of being part of the solution - the intangible benefits of that feeling is unexplainable.

    Wish us luck and my best to everyone in all their endeavors.

    All the best to all of us. The only way we can make our way out of this mess is by sticking together and helping each other out. IV is doing a good job of rallying everyone around and I think all things considered we are doing a good job of doing the best we can.

    Well numbersusa are against any immigration and they will always use illegal immigration as the vehicle to couch and attack any form of immigration. Their ranks consist of both democrats and GOP. Generally those who are threatened by any sort of immigration. Union workers in MI would be group in sync with numbersusa. So also would be buidling workers where there is strong competition from Hispanic workers walking accross the border.

    I personally think businesses have been promised action on issues after the election. If not by now businesses would have entered the fray. H1B and skill bill and also the agjobs will be definitely passed due to pressure from big businesses. Economy is strong and they are not able to fill positions.

    Any update on your FP. Im still waiting for mine. I dont know how many are like us.
    As you said my only concern is will it impact EAD renewal in any way?
    People, please throw in some comments who have not received their FP yet

    No FP yet. Got a response to my SR indicating that I will get the notice once the appointment is available at my local ASC.

    I am in same situation who has sept 10th ND from TSC , no FP for me or my wife. I did open a SR and i got a response letter saying that either your FP has expired or clearance has not been received.. will send one by mail soon.

    It has already been 45 days since the letter was dated. NO FP nothing.

    Has going to IO helped anybody is getting a FP notice? That seems my last resort.



    No update from my side. I had called last week and week before that. Apparently I got the same IO the last two times and first time she told me no FP scheduled , security check cleared. Second time she said no FP scheduled and I asked about security check and she said its still pending. Imagine same IO giving inconsistent information regarding my security check. I am not even sure to believe anything they say anymore. I am not even sure if they really look it up or not.

    That is probably the most absurd thing said in this forum.

    Purgan, please do some basic research and you will see you are plain wrong. There is no way you will see your dream coming true. Govenment intervention when it comes to regulate the influx of foreign labor is everywhere. It is controlled. You just allow less or more people coming in and that is fair. If you allow the gates of a third world country to open for good and flood this with programmers to a point where you would be making $10/hour, nobody sane wants to get downgraded to that level. Foreigners with a funny accent like us would be competing for jobs. Probably employers would love and exploited people in the third world countries would love that, but I have to tell you things don't work that way.

    Similar polls were conducted by Zogby, CNN, etc. I outlined other evidences there. Only individuals with an open mind can read between the lines though.


    when american's from such third rate schools are not getting jobs, do you seriously think foreigners with their funny accents and relatively poor English communication skills (I'm Indian and can tell you its still a second language to me) can get jobs??

    The market has a way of regulating itself. As someone mentioned above, there were a a lot of H1 space available from 2001-03. But it never got filled because there were simply not enough jobs. Lets not try to set up govenment intervention here....let the free market decide....that is what made this country great.

    btw, NumbersuSA, FAIR and other restrictionist organizations have zero credibility because they oppose even legal immigration.

    1. When IV sucessfully reversed USCIS decisions last July
    2. Two year EAD's.

    Recapture would have solved the above problems automatically to

    EB3 I issue being debated now is something we wish we could have but has not much logical ground,in my understanding. July issue is to do with flip flop of USCIS. IV didn't protest to make all current. Just made them not retract what USCIS/DOS said a month back.
    2 year EAD is also for the whole community including future filers.

    Clarify one thing for me. How this new rule that is helping EB2-I is impacting EB3-I. Based on what I understand, EB3 World is directly impacted by this change. Can you help me understand how EB3 -I is impacted?

    You've mentioned a few times on this forum that on AC21, the job needs to be "permanent." That is misinformation, since the Yates memo you quote doesn't say that. Also, what do you mean by a "permanent" job? I haven't seen a job offer letter in the US saying that the job would be "permanent" (whatever that means). Also, is a "legitimate" employment? Could you quote a USCIS resource?

    Another misinformation I've seen on this forum is advising people to "file AC21." First, no USCIS resource mentions procedure for that. Second, you're are *not* required by USCIS to inform them of every job change if you're invoking AC21.

    FYI I received my EAD card this morning!!! I know yours are all coming soon! It never updated online it just said that the approval notice was sent- it never said card ordered.
