    If Dream act becomes law, I will throw my visa documents and register my self as undocumented alien with undocumented birth certificate and get degree from a community college and get the visa.:D

    You wont be able to do that if you entered the US at an age more than 16yrs old
    DREAM Act beneficiaries must:

    Have proof of having arrived in the United States before age 16.
    Have proof of residence in the United States for a least five consecutive years since their date of arrival, compliance with Selective Service.
    Be between the ages of 12 and 35 at the time of bill enactment.
    Have graduated from an American high school or obtained a GED.
    Be of "good moral character"[12]


    That is why we need to participate in this action alert and have them consider our ammendments.

    With a successful flower campaign to USCIS, we must draw our conclusions from this success, and use the outcome to make the San Jose rally a success.

    Please note that legal immigrants is a small handful set of people. Just a usual rally/demonstration will not make a dramatic impact. We have learned from the flower campaign that if we use innovative-peaceful ways of demonstrations, and manage Public Relations and Media well, we can be successful once again.

    Please think and try to come up with some ideas. I have come up with these four ideas:

    1. Project Martin Luther King Jr. as our hero in these rallies: Please understand that local Amrican people better understand about Martin Luther King Jr. andhis idealogy then M.K. Gandhi. My suggestion is that we should include large picture posters of Martin Luther King Jr. with a slogan "We legals too have a dream". We should also take Gandhi's posters. There is a possibility that all Black American organization may lend their support to us.

    2. An act that attracts media attention: Please remember the scene from Gandhi movie when protesters led by Gandhi peacefully burned their resident permits in South Africa. To do something similar and show our symbolic protest against USCIS, we can publically burn a Photocopy of our H1B approvals (I-797). Please note that we are not asking people to burn the original I-797 approval but a photocopy of the document. This will send a message that taking the great pain in obtaining these legal documents are not helping us getting a better treatment by USCIS. This act will perfectly portrey the pain of legal immigrants and once again will attract media and newsprint to keeps us in headlines. This should be part of our demonstrations.

    3. Waive American Flags: Please understand that recent media reports that only Indians are responsible for the flower campaign may hurt the campaign in the longer term. Please waive small American flags and show our solidarity with local Americans.

    4. Distrubute a flower with a pamphlet to the people passing by at the demonstration site. A well worded paper will be required that can project our problems to the people.

    Please share if you come up with innovative ideas to make these rallies a huge success.

    Question to IV core...

    After receiving the standard email respose from the congressman/senator...I am wondering are they even aware about the legal immigrants. All we are getting the standard template which is talking about only illegals and DREAM.

    No mention about legals ?

    Yes generally these replies come in from one of their workers, maybe even a trainee.

    Thats why IV wants everyone to call back the Senator/US Reps office mentioning the email response, and ask why our problems were not addressed (legal immigrants) and that you need more clarifications. Typically they have a person handling immigration issues.
    mentioning only the two we are campaigning for right now:
    1. Employment based Visa recapture
    2. Protecting children of legal immigrants from aging out regime

    this is even more important than just sending an email
    Better yet if you can meet if not call in the next 7-10 days.

    I would request as whole us know that CIR will not comeup this yeat..I would request if there is any plan IV is mkaing in this regard. I dont think waiting until end of July and then proceed for new bill is good way...

    I would request to look for some alternatives from now itself..atleast filing 485 under retrogression and 3 year ead/ap..

    any thoughts about this?

    Apahilaj,

    Buddy, it looks like its only you and me remaining who has not received the FP notice. For me its been 30 days since opening SR and nothing. We are the unfortunate ones who have not only not received FP but our application are in TSC , where opening an SR is of no use.

    We may want to try a different strategy to inquire about our FP rather than calling that number floating around which is of no use to us. All I got from calling that number was WAIT , Local ASC must be busy.

    I am not sure InfoPass appointment will help, but hope its worth trying.

    I am July Filer too I have not received evn a single receipt for anything. I called USCIS they said it is taking from 90 to 120 days so wait and call.

    At least Bush Administration was sympathetic to our cause. Everyone knows that this is a congressional fix but alteast Bush never came up with those anti-H1b policies to destabilize people in GC queue. Now these numbers have retrogressed in month of June when historically this has never happened. Obama is trying to woo people at the cost of Indian community.
    Everyone knows Durban & how he has lately tried to screw Indian community and Obama is a good friend of Durban. Now Democrats are in majority , why have they not fought for your cause ? There was an idiot congressman in IV Dc rally who was talking about making all illegals legal from IV stage. So what else u can expect ?

    Come out of Obama Dreams & fantasy world. Obama is not good for us. He is good for illegals and any immigrant who is aspiring a blue collar job. They don't want you & me taking white collar jobs. He is helping right-wing white supremacist agenda by aligning himself with people like Grassley & Durban.

    I believe you are very close to the truth matter.
    Bush, deport and detain illegal immigrants while expanding and ignoring any frauds in H1/L1/etc programs for 8 years. Obvious, Bush thinks our future voting block will be in republican favor and illegals future voting block would be in democrats favor.

    Now we see with Obama he is acting in the opposite manner. He wants to legalize illegals to create a future voting block and to penalize and stop/disarm the h1/l1/etc programs because he believes we will not vote for democrats when we become naturalize.

    I will be sending this letter on Monday anyways because we need to do something our voices are being DROWNED out by the ANTI's!!!

    caveat - you teach best what you most need to learn (richard bach?)

    We'll find other things to worry about after the GC. However, I think a focus on learning/self improvement, health (exercise and meditation should go a long way..although i haven't really spent as much time as i should on this) and most importantly on financial objectives should help.

    Most of us are here to secure our financial futures. Focus on good investing practices, learning how to invest both your money and in yourself. The worst thing we can do is to be paralyzed in thought and action by USCIS processes.

    again....you teach best what you.....

    Tell me what wrong he did for him to apologize and I will apologize to you. When nothing is permanent he worked with them for 1 and half years, he got them 4 employees. Why in the world should he apologize?.

    When you say that you will not need your clients you are wrong. when I was searching for projects I got a chance to apply to a job opening in one of my previous client, guess what, the start to my second stint was smooth just because I had a good rapport with my client and they liked my work. I even got one of my team mates in my client place to give me a referral for my higher studies.

    "Your ex boss is not a bad guy, he knows you are leaving for better opportunity".He is not only a bad guy, he is evil IF (note the big IF) he is keeping the money which is not his. Their conscience should prick when they feed and give excellent education to their kids with the ill gotten money.


    Unfortunately one might need his ex-employer in future (might not always be the case) and that is the irony of it all.

    What wrong he did? Nothing illegal but certainly not the best practise. Atleast he has been insensitive to his former employer.

    Equating labor substitution with porting is real silly. Labor substitution was clamped down, because of abuse, however it didn't mean that it was wrong by its very virtue. However the abuse lead to its closure.

    As for porting, I don't see any scope for abuse. Cuz the process is in such a way, that one has to refile labor, 140, and all the exact procedures similar any freshly new EB-2 candidate would. The only difference is that at the end, one has option to request his/her earlier date.

    And rightly so, because there's a difference between two Eb-2 filers. One who has not filed anything before, and one has filed "SOMETHING" before. That "something" holds the merit.

    rightly said... Here is a simple analogy... compare the porting scenario to someone who just joins a new company with 10 yrs experience and someone who has been with the same company for 10 years. If one of them has to be promoted, who will it be ? Or if the company is now going under, who will get fired first ?

    The fact that a person has been with a company for 10 yrs holds enough merit when the company decides who gets promoted or who gets fired. So my friend stand in line like everyone else based on your priority date. That is your place in the line as per law.

    Googling the company name brings up some interesting information. The company seems to be well-established and looks like it has some ties to the federal government in terms of clientele..

    I would assess the situation carefully and come up with a strategy before you take further steps...

    ok, let me put the matter to rest before you take it out of context. My observation was based on the thread that we had for collecting the amount..I didn't see many EB3 folks contribute dollars....but now that 2 EB3 are vouching that enough EB3 folks contibuted, that's great. I just observed something and if it hurt you right down the spine, sorry. I filed PERM 3 months ago, I'm far off in this process. Just focus on advocay so that everyone gets their GCs. Good luck. I hate this EB2 vs EB3, this is a never ending debate. Just hope everyone gets their GC in time.

    Nothing personal. I appreciate everybody's contribution and efforts. I was trying to dispel the notion that PD progress is somehow related to how much we contribute to advocacy efforts. That is just not true.

    same with my spouses EAD application. My 485 is pending in NSC. Spouse's EAD pending at TSC, ND July 22 no LUD's yet..
    My spouse's current EAD expires on Sep 26. Hope to get the EAD by then:confused:

    Same with me. 485 pending at NSC, EAD pending at TSC - as per instructions in I765. NO Luds, just silence.

    I feel much better. These are trying times for sure.

    Loads of work at the office, moving from one city to another and above all...this frustrating wait --- Its 2 much 2 handle. But I'm with u guyz...I think I shud just STFU N wait.

    This is an ultimate test from above on our patience.

    I waited for a very long 10+ yrs for my process to complete. Will you beleive that during the first 3 yrs of my application all the categories were current. The very next month when my labor got approved it went to retrogression. Before I got greened 2 weeks back, the dates became current for 3 times. I missed all 3 times. Last one was becuase of idiot lawyer (her firm is one of the largest immigration law firms in the entire country) sat on it and did not provide a required paper work.

    After that the wait got extended for another 3 more yrs. finally got it on early part of this month. With the same process I was laid off once. Ported the process out. Then second company tried to ditch me the process. Ran away from their with the process. Got really lucky. From 3rd company I was forced to take a package and leave. Got lucky there too to port the case for a record 3rd time. Filed AC21 with the 4th company. Later filed I 140 again (i don't know why. The lawyer of the cmpany insisted). Got that once also approved.
    Spend almost 38,000.00 dollars in all these various processes. After all these waited for almost another 2 yrs again and finally it arrived.....

    So each story is different. Each has got its own colors. I have worst situations than mine. Just hang in there buddy. Your turn is round the corner. It is on its way.

    LUD: July 08, 2008
    Current Status: My case was approved and card production ordered on August 14, 2008 (got the email from CRIS) and still waiting for my spouse's EAD approval.

    Is July 08, 2008 also the Notice Date on your receipt notice? I'm wondering if generally there is one more LUD after the notice date and before the approval, when they pull the file off the shelf and start working on the case.

    The question is if one has worked as a contractor and got a employment RFE and the company provided a letter stating a full time consultant job, has USCIS rejected such a response?

    Answer is NO.
